1. Introduction

Welcome to Carpture ("we", "us", "our"). These Terms and Conditions govern your use of our mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our App.

2. About Us

Carpture is currently operated as an individual (sole trader) based in the United Kingdom. A registered company may operate the App in the future, at which point these Terms may be updated.

3. Eligibility

You must be at least 13 years old to use this App.

If you are under 18, you confirm that you have permission from a parent or legal guardian to use the App.

By using the App, you confirm that you meet these requirements.

4. User Accounts

To access core features, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Be responsible for all activity on your account

We use Supabase for authentication. By creating an account, you also agree to Supabase's applicable terms.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Social Features

Carpture includes social functionality. Users may:

  • Create public profiles
  • Follow other users
  • View publicly shared content

You understand that any content you post publicly may be visible to other users and cannot always be fully removed from circulation.

6. User Content

Our App allows users to create and share content, including:

  • Spots (locations)
  • Images
  • Comments
  • Forum threads and replies

You retain ownership of your content. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute it within the App.

You agree not to post content that:

  • Is unlawful, harmful, or misleading
  • Infringes intellectual property rights
  • Contains abusive, offensive, or inappropriate material
  • Includes false or dangerous location information

We reserve the right to remove content or restrict accounts at our discretion.

7. Content Moderation & Reporting

We may (but are not obligated to) monitor content.

Users can report content that violates these Terms. We reserve the right to:

  • Remove content without notice
  • Suspend or ban users

8. Location Data

The App uses location data to power core features such as creating and discovering spots.

  • Location permission is requested on first use
  • Location is required when creating a spot
  • Location data associated with spots is stored persistently

You are responsible for ensuring that any location data you submit is accurate and appropriate to share.

9. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes
  • Attempt to gain unauthorised access to systems
  • Interfere with or disrupt the App
  • Scrape, copy, or extract data using automated means

10. Monetisation

The App may include:

  • Advertisements
  • Paid features or subscriptions (current or future)

We reserve the right to introduce, modify, or remove monetisation features at any time.

11. Intellectual Property

All content and materials in the App (excluding User Content) are owned by us or our licensors.

You may not reproduce or distribute any part of the App without permission.

12. Third-Party Services

The App relies on third-party services, including:

  • Supabase (authentication)
  • Amazon Web Services (storage, hosting)

We are not responsible for third-party services or outages.

13. Limitation of Liability

To the fullest extent permitted by law:

  • The App is provided "as is" and "as available"
  • We make no guarantees about accuracy, reliability, or availability

We are not liable for:

  • User-generated content
  • Inaccurate location data
  • Any loss of data, profits, or business
  • Any indirect or consequential loss

Nothing in these Terms excludes liability that cannot be excluded under UK law.

14. Beta Disclaimer

Carpture may be in an early or evolving state. Features may change, break, or be removed at any time.

15. Termination

We may suspend or terminate your access at any time if you breach these Terms.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales.
